In Weaver v. Metsker, a falling branch caused a serious injury. The appeal turned on what the evidence showed about who knew of the danger. The court allowed the case against the tree owner to continue and left the public bodies out of the case. It did not award compensation, decide ultimate liability or rule on insurance coverage.
What the animation explains
- What happened and why notice of the danger mattered.
- Why the evidence against the tree owner and the public bodies led to different results on appeal.
- What the ruling leaves open, including the separate question of what an insurance policy might cover.
